The “Lessor of Evils” as a Defense for Marijuana

I must start out with a initial plea of Guilty but Innocent in Order to initiate the Process of establishing no “Mens Rae” with the Motion of a “Lessor of Evils” defense, based on having no other choice but evil in the case at hand!

As for guilt, I have none and I have already proven it by my already having plead Guilty and Not! Based on a Motion for a “Lessor of Evils”.

I am then given the chance to introduce all the evidence in Court that in fact proves my innocence and my lack of guilt in the case or crime I am being charged for…

The real two evil choices you/we are currently given in a Marijuana Case is either ~

A)

I/you/we know we are being forced into choosing between the Evil of choosing to “Uphold” an evil Abusive LIE… = Unconstitutional Controlled Substance Act = Prohibition which they created to divide the Market place for double the profit in order to drive prices, as this also allows for more venues or avenues, for them to profit in while they enslave everyone we love… and everything through their unconstitutionally declared “Foreign Synthetic War” on Nature, I mean drugs! The “drug war” which evidence shows has already destroyed too much and too many in America… While be forced to give up my/your already won Supreme Court decision of Leary vs The U.S, which established Constitutional Inalienable Sovereign Freedoms and Rights… While we bend over for Evil…

B) We risk being deemed evil and getting arrested, criminalized, going to prison, or even worse dying… shot by a cop… For doing the right thing and flexing my Constitutional Inalienable Sovereign freedoms and rights to utilize this plant untaxed, which was upheld in the Supreme Courts Ruling in Leary vs The U.S.!

For my/your/our needs and or the needs of others…

Which they have deemed as evil? And want to call me/you/us a criminal for  violating and breaking their Unconstitutional Illegal overreach and Acts of Congress and Statutes… Not Law! to use this non-toxic food as it was freely Divinely and Sacramentally given to us as a nontoxic most nutritious meat first!  As we also now know that we are all in fact, Endocannabinoid based species or life forms and we also know that it is in fact malnutrition that causes the majority of disease and death…

I want to personally thank you from the bottom of my heart for your contribution that has helped so far in this struggle. The GoFundMe money was raised for legal fees and expenses surrounding the case, the money has been allocated and the site taken down. A new funding site will be made as further legal contributions are needed, and will be handled as the case continues. Legal funds do not account for living expenses. I believe in persistence, perseverance, and working hard to achieve goals.

Many of you have seen what has happened in my life over the course of the last year, when police surrounded my home after my son spoke out in class. You have followed me in the past year as I have attended many court dates, struggled with pain and anguish, and watched me face this court system with my head held high.

I have a certainty, a clarity in my fight against these unjust laws. I fight with no fear, I hold my head high, knowing I am in truth. Knowing that I have a basic right to life, a basic right to live! I have faced death head on, I have struggled and felt torturous pain inflicted upon me by the barbaric medical system our society clings to and calls normal. I know I can stand tall and proud in truth, knowing it was all foretold.

Knowing that my journal, of finding how beneficial this cannabis plant was, and being able to share my personal thoughts, feelings, and experiences had to be written and published in 2010. I explain, in detail, my sickness, my life, my family, and how I teach my children; all surrounding the cannabis plant and how this plant made me feel as my body regenerated and healed.

(NaturalNews) Hemp oil extracts containing CBDs (cannibidiols) are such a threat to the pharmaceutical industry that the FDA is now invoking totally insane justifications for outlawing them.
CBDs are non-psychoactive compounds found naturally in hemp plants. They work so well as powerful natural medicine that people everywhere are realizing CBDs work better than pharmaceuticals for treating epilepsy, seizures, neurological disorders and other serious health conditions (including HIV infections).
So the FDA has just launched a massive regulatory assault against CBDs by invoking the most insane logic you’ve ever heard. Here’s how it goes:
1) CBDs work so well that drug companies are now investigating them to be approved by the FDA as medicines.
2) Because CBDs are being investigated by drug companies, the FDA has granted CBDs status as being “investigated as a new drug.” In the FDA’s own language from their website, “FDA considers a substance to be ‘authorized for investigation as a new drug’ if it is the subject of an Investigational New Drug application (IND) that has gone into effect.”
3) Because CBDs work so well and have been authorized for drug investigations, the FDA now OUTLAWS them being sold as dietary supplements. Per the FDA’s own website: “FDA has concluded that cannabidiol products are excluded from the dietary supplement definition under section 201(ff)(3)(B)(ii) of the FD&C Act. Under that provision, if a substance (such as cannabidiol) has been authorized for investigation as a new drug for which substantial clinical investigations have been instituted and for which the existence of such investigations has been made public, then products containing that substance are outside the definition of a dietary supplement.”
4) Now the FDA has begun sending warning letters to CBD makers, claiming they are in violation of FDA regulations because they are selling “adulterated products.” Adulterated with what, exactly? CBDs, of course! “The debate over hemp CBD’s legal status continues after FDA sent eight warning letters to manufacturers of CBD dietary supplement and food products earlier this month,” reports Nutritional Outlook. “The warning letters cite impermissible health claims used to market the products, as well as CBD’s invalid status as a dietary ingredient due to its presence in two drug applications currently under consideration.”

The FDA just criminalized one of the most miraculous healing medicines in the world by handing it over to Big Pharma

In other words, the FDA just handed Big Pharma an absolute monopoly over CBDs (hemp oil extract) by ridiculously claiming such natural products are “adulterated” with molecules (CBDs) that the FDA says might one day become a drug.
“Drugs,” according to the FDA, are substances that are proven to treat, prevent or cure a disease, and thus the FDA’s own logic admits that CBDs must be able to treat, prevent or cure diseases, otherwise they would be useless as “drugs”.
But when a dietary supplement company makes the same claim, they are hit with aggressive warning letters from the FDA, threatening to shut them down, confiscate their products and seek criminal prosecution of the company executives.

This is how the FDA can instantly criminalize any vitamin or plant extract

Do you see how this twisted, corrupt regulatory tactic can allow the FDA to instantly criminalize any dietary supplement, vitamin, herb or plant extract?
Vitamin D, for example, could be outlawed by the FDA announcing that it has granted “Investigational New Drug application (IND)” status to any drug company studying vitamin D.
Using this same corrupt, mafia-style tactic, the FDA could outlaw resveratrol or even vitamin C, denying Americans the right to access safe, affordable, natural substances that are routinely found in nature.

It’s time to end the FDA’s monopolization over natural plant molecules

If humanity is ever to achieve medical freedom, we must end the FDA’s outrageous medical monopolization of plant molecules such as CBDs. By allowing this corrupt, criminally-run regulatory agency to criminalize every molecule found in nature, our nation’s lawmakers condemn us all to life in what can only be called medical totalitarianism under FDA tyranny.
Any time a healing substances is found in nature, the FDA can simply assert that such molecules are now in the process of being studied as drugs and are therefore illegal to sell as dietary supplements even though they were developed by Mother Nature, not drug companies.
This FDA tactic is nothing more than the FDA proclaiming intellectual monopolies over all molecules of interest found in nature. It is Monsanto-like in its arrogance and wickedness, and it deprives the People of their right to access medicinal plants and healing substances that have existed in nature for countless thousands of years long before the FDA ever came into existence (1906).
If we do not stop this FDA, we are all doomed to living under a totalitarian regulatory regime that will systematically criminalize every healing molecule found in nature, from the curcuminoids in turmeric root to green tea catechins and even phycocyanins found in spirulina.
That this federal agency has now resorted to such tactics of medical totalitarianism and outright tyranny is proof that we need to strip the FDA of regulatory powers over natural dietary supplements and limit its domain to pharmaceutical drugs only.
Coincidentally, a Presidential election is upon us that threatens to shake up the entire establishment if the right person wins. “Establishment” candidates on both sides of the aisle would simply continue the FDA war on natural molecules that’s now under way, but there is one candidate who has openly threatened to challenge the authority of federal regulators like the EPA and FDA.

FDA begins crackdown by targeting inaccurate label claims… but it won’t end there

The FDA has now declared war on CBDs and hemp oil extracts. Its first targets are those companies who have inaccurate label claims or are committing outright fraud in claiming CBD concentrations that don’t even exist in their products.
On this point, I must agree that inaccurate label claims deserve regulatory enforcement. The CBD industry is heavily populated with fraudulent sellers whose products often contain no CBDs at all.
“The FDA has turned its back on the cannabis industry, claiming that CBD products cannot be sold as dietary supplements,” reports Canna Business. “Companies affected by the latest crackdown include Cali Stores, Dose of Nature, Green Garden Gold, Healthy Hemp Oil, Michigan Herbal Remedies, Morgue Juice, Pain Bomb and Sana Te Premium Oils. According to the FDA’s analysis, all products contained different amounts of 9-THC, THCa, CBDa, CBN and CBD than they had claimed.”
The second target of the FDA is companies that made disease treatment claims that their CBD products might treat epilepsy, cancer or other conditions. The FDA, of course, routinely attacks any dietary supplement maker that tells the truth about the medicinal benefits of their products. According to the FDA, there is no such thing as any food, nutrient, herb or natural molecule that has any ability whatsoever to treat, prevent or cure any disease. This position is, of course, patently absurd and stands in total violation of nutritional science, but it is the “big lie” the FDA must maintain in order to keep putting dietary supplement companies out of business.
Once the FDA finishes destroying all the companies with inaccurate labels and disease marketing claims, it will target all the honest suppliers of CBDs who are selling genuine, honest products that contain accurate CBD labels. This is the real goal of the FDA: to threaten, intimidate and destroy the entire CBD industry and thereby protect the medical monopolies of drug companies that can’t wait to cash in on these amazing molecules that really do treat disease (otherwise, Big Pharma would have no interest in them).

And so the great medical monopoly racket marches on, with the FDA giving a big “F-YOU” to the American people while handing lucrative medical monopolies to its greed-driven friends in the pharmaceutical industry. Meanwhile, the American people are denied healing medicine that works at a fraction of the cost of overpriced pharmaceuticals.
Entrepreneurial companies that offer such hemp oil extracts containing CBDs — natural medicines that could help reduce human suffering while lowering health care costs nationwide — are threatened by the FDA with devastating enforcement actions that could land their executives in prison.
This is all part of the FDA’s war on natural medicine that systematically criminalizes molecules found in nature and the people who seek to make those molecules available to patients in need. While disease suffering skyrockets across America and medical expenses push more and more families over the threshold of bankruptcy and destitution, isn’t it comforting to know that your federal government is doing everything in its power to deny you access to safe, affordable natural medicine while protecting the profits of the drug giants?

What can you do to oppose this medical tyranny by the FDA?

None of this is ever going to change, by the way, if we keep electing establishment politicians to the White House. If you want to see real change in the legalization of hemp extract components such as CBDs, you’d better vote for someone who terrifies the establishment and threatens to tear it down.
At the same time, you need to support health freedom organizations like the Alliance for Natural Health, which is fighting to keep dietary supplements legal in America.

There is a nationwide effort under way right now to criminalize ALL dietary supplements and force every plant extract, vitamin or food concentrate to be regulated by the FDA as if they were prescription drugs. This would utterly wipe out the entire dietary supplements industry and plunge America into an era of runaway disease, suffering and death as people are denying access to the healing nutrients that are presently preventing disease (and even reversing serious disease in some cases).

#1 Congress Reauthorizes Medical Marijuana Protections
Members of Congress approved language in the fiscal year 2016 omnibus spending bill that continues to limit the federal government from taking punitive action against state-licensed individuals or operations that are acting are in full compliance with the medical marijuana laws of their states. The provisions reauthorize Section 538 of the Continuing Appropriations Act of 2015, which states, "None of the funds made available in this act to the Department of Justice may be used … to prevent … states … from implementing their own state laws that authorize the use, distribution, possession, or cultivation of medical marijuana." #2 Federal Judge Upholds Marijuana’s Schedule I Status
A federal judge in April rejected a motion challenging the constitutionality of cannabis’ classification as a Schedule I prohibited substance. "At some point in time, a court may decide this status to be unconstitutional," Judge Kimberly Mueller said from the bench. "But this is not the court and not the time." States that permit qualified patients to access medical marijuana via dispensaries possess lower rates of opioid addiction and overdose deaths, according to a study published in July by the National Bureau of Economic Research, a non-partisan think-tank. The findings mirror those published in 2014 in The Journal of the American Medical Association concluding, "States with medical cannabis laws had a 24.8 percent lower mean annual opioid overdose mortality rate compared with states without medical cannabis laws." Despite threats from members of Congress, District officials implemented voter-approved legislation earlier this year eliminating penalties associated with the possession and cultivation of personal use quantities of marijuana by adults. #5 Marijuana Law Changes Don’t Change Youth Use, Attitudes
Rates of youth marijuana use are unaffected by changing laws, according to data published in July in The American Journal of drug and Alcohol Abuse. Investigators evaluated trends in young people’s attitudes toward cannabis and their use of the substance during the years 2002 to 2013 – a time period where 14 states enacted laws legalizing the medical use of the plant, and two states approved its recreational use by adults. "Our results may suggest that recent changes in public policy, including the decriminalization, medicalization, and legalization of marijuana in cities and states across the country, have not resulted in more use or greater approval of marijuana use among younger adolescents," researchers reported. #6 Gallup Poll: More Americans Than Ever Say Marijuana Should Be Legal
Fifty-eight percent of Americans believe that "the use of marijuana should be made legal," according to nationwide survey data released in October by Gallup pollsters. The percentage ties the highest level of support ever reported by Gallup, which has been measuring Americans’ attitudes toward cannabis since the late 1960s. #7 Study: Marijuana Use Not Associated With Changes In Brain Morphology
Marijuana use is not associated with structural changes in the brain, according to imaging data published in January in The Journal of Neuroscience. Investigators assessed brain morphology in both daily adult and adolescent cannabis users compared to non-users. They found "no statistically significant differences … between daily users and nonusers on volume or shape in the regions of interest" after researchers controlled for participants’ use of alcohol. "[T]he results indicate that, when carefully controlling for alcohol use, gender, age, and other variables, there is no association between marijuana use and standard volumetric or shape measurements of subcortical structures," researchers reported. #8 Marijuana Consumers Less Likely To Be Obese, Suffer Diabetes Risk
Those who consume cannabis are 50 percent less likely to suffer from metabolic syndrome as compared to those who do not, according to findings published in November in The American Journal of Medicine. Metabolic syndrome is a group of risk factors, including high blood pressure, high blood sugar, unhealthy cholesterol levels, and abdominal fat, which are linked to increased risk of heart disease and adult onset diabetes, among other serious health consequences. The findings are similar to those of previous studies reporting that those who use cannabis are less likely to be obese or suffer from diabetes. #9 NHTSA: THC-Positive Drivers Don’t Possesses Elevated Crash Risk
Drivers who test positive for the presence of THC in their blood are no more likely to be involved in motor vehicle crashes than are drug-free drivers, according to a case-control study released in February by the United States National Highway Transportation and Safety Administration. Authors reported that drivers who tested positive for the presence of THC possessed an unadjusted, elevated risk of accident of 25 percent (Odds Ratio=1.25) compared to controls (drivers who tested negative for any drug or alcohol). However, this elevated risk became insignificant (OR=1.05) after investigators adjusted for demographic variables, such as the drivers’ age and gender. The study is the largest of its kind ever conducted in the United States. #10 Legal Marijuana States Collect Over $200 Million In New Tax Revenue
Taxes on the legal production and sale of cannabis in the states of Colorado and Washington have yielded over $200 million in new revenue since going into effect in 2014, according to calculations reported by The Huffington Post in September. Colorado collected more than $117 million dollars from marijuana sales while Washington collected over $83 million. Cannabis sales commenced in Oregon in on October 1, 2015 and have yet to begin in Alaska. FBI must explain prioritizing environmental activists on its terrorist lists – journalist (VIDEO)

The public deserves to know why the FBI singles out environmental or left-wing activists – some from decades ago – as top terrorist suspects on its most wanted lists, as opposed to violent right-wing fugitives, journalist Will Potter told RT.

Potter, an investigative journalist and author of "Green is the New Red: An Insider’s Account of a Social Movement Under Siege," recently wrote a post on his website that questions the Federal Bureau of Investigation’s terrorism priorities, especially in light of the agency’s well-known past abuses. He noted that all of those on the agency’s Most Wanted Domestic Terrorism list are either leftists who committed crimes at least 30 years ago, or environmental/animal right’s activists accused of property crimes, not physical violence.

 

"Over and over again, we’re seeing this overreaching of FBI responsibilities, and going after protest groups and politicizing their duties," he told RT in an interview. "It’s time for all of us to examine how those powers are being used, and I think it’s time for a congressional inquiry as well."

Potter pointed to recent revelations exposing the FBI’s unlawful surveillance and intelligence gathering aimed at "extremist" environmental activists opposed to the Keystone XL oil pipeline, which was called "vital to the security and economy of the United States" in FBI documents.

"I think the most important takeaway (of the FBI’s domestic terror list) is not the individual crimes or what these people are accused of, but the bigger priorities that the FBI is putting forward," he said.

"The purpose of this list is to put a giant spotlight on what the FBI wants to focus its resources on. And when the FBI is focusing resources on environmentalists, or people who are accused of destroying property, or political activists from the ’70s, that means they’re not focusing resources on today’s criminals and actual right-wing groups that have murdered people and sent anthrax, (and) murdered abortion doctors. That should really give everybody pause of how our taxpayer money is being spent."

The targeting of environmental activists is no accident, Potter explained. It’s part of the FBI’s current mission and not an aberration, especially in an era of federal legislation, such as the Animal Enterprise Terrorism Act, a sweeping law that labels and punishes as "eco-terrorism" numerous political activities or civil disobedience conducted in the name of animal rights. The law covers action that "damages or causes the loss of any real or personal property" or "places a person in reasonable fear" of injury.

"It may seem like isolated incidents where you have these environmentalists on a most-wanted list, or the FBI is talking about animal-rights activists, but these are really systemic problems."

Potter said he wants to know how the infamous J. Edgar Hoover-era FBI spying programs, which once targeted Black Panther members and anti-war activists, have evolved to include today’s targets despite public admonishments of invasive, repressive surveillance operations.

"It’s important to remember that the FBI has a history of abuses like this," he said. "That’s why accountability and oversight are so important. During the 1970s and ’80s, there was surveillance and harassment, a program called COINTELPRO spied upon and disrupted social movements. And after that, there were congressional hearings. (Surveillance of activists) was supposed to stop, it was all over with. That was the message we were told. I think now we have to revisit that and find out actually what’s the scope of what’s taking place today, whether those tactics evolved into something new."

Potter said the imbalance in the FBI’s most wanted list is exemplified by left-wing environmental or animal-rights activists, who have been included based on property crimes that have not harmed a human being, while right-wing militia members who have perpetrated violence on people are not on the list.

"The crimes that the people on this most wanted list are accused of, some of them are serious property crimes," he said, "but it’s important to point out that in the history of these groups, no one has ever been hurt, and that’s never been their intention, whereas with right-wing groups in particular, militias, sovereign citizens, anti-abortion groups, that’s been the explicit purpose.

"You can’t ignore these things when you’re prioritizing crime. And why is that? Someone at the FBI needs to explain their justification for not including those groups while focusing so much resources on environmentalists."

Economic damage, not physical injury or loss of life, has guided the FBI’s so-called "anti-terrorism" operations against environmental activists, Potter said.

“What started as a corporate-driven agenda to label protesters as eco-terrorists has become institutionalized,” he told Vice last month. “This has really become standard operating procedure, and I think that’s what’s most disturbing about this.”

In January, a man sentenced to 19 years in prison for conspiring to commit "environmental terrorism" was granted early release after nine years of incarceration once it came to light that prosecutors withheld evidence from the defense. Eric McDavid’s defense had claimed FBI entrapment in the case, saying an agency informant housed, fed, and encouraged McDavid and co-defendants to plot illegal activities, while using FBI surveillance equipment to relay their interactions back to the authorities.

Make the FDA Advisory, Not Mandatory

You should control what medicines you use, not the FDA. The FDA should make advisory recommendations only. It should NOT have the power to mandate which drugs you can buy, and which you cannot.

  • If pharmaceutical companies value the FDA seal of approval, then they can pay the FDA to evaluate their drugs.
  • If consumers value FDA approval, then they can decide to only buy FDA approved drugs.

If the FDA’s seal of approval is really so valuable, then it does NOT need to be mandatory. No coercion is necessary. Instead, the FDA should be able to sell its services through voluntary means, just like Underwriter’s Laboratory does.

Consumers and doctors should be free to consult available science, and make their own decisions about which treatments to try.

All human beings are unique. Treatments that might be dangerous for one person, could be the only possible solution for another. There is zero chance that one-size-fits-all dictates can possibly account for the vastness of human variability. Patients and doctors must have the flexibility to deal with individual human uniqueness.

The FDA should serve, not rule.

There are thousands of reasons why the FDA should lose its power to coerce you and your loved ones. Some of these reasons will be listed below, so that you can use them when writing to Congress, or when asking your friends to contact Congress on this issue . . .

The FDA gives consumers a false sense of security. Americans assume that the FDA is actually protecting them, but it is not. For instance . . .

The Union of Concerned Scientists surveyed 6,000 FDA scientists in 2006, and 1,000 of them responded with the following disturbing admissions:

  • 17% admitted that they had been "asked explicitly by FDA decision makers to provide incomplete, inaccurate, or misleading information to the public, regulated industry, media, or elected/senior government officials."
  • Less than half agreed that the FDA "routinely provides complete and accurate information to the public."
  • 47% admitted to being aware of instances "where commercial interests have inappropriately induced or attempted to induce the reversal, withdrawal, or modification of FDA determinations of actions."

The FDA is constantly attempting to expand its powers. The people in that agency are relentlessly pushing into areas that are NOT part of their mandate — even where there is NO problem that needs to be fixed.

For Example: The FDA has made repeated attempts to regulate vitamins and supplements, even though there is no evidence that these things present any danger. Quite the contrary — vitamins and supplements are a powerful example of how health outcomes can be improved, without FDA involvement. The website of the Life Extension Foundation is full of scientific citations to demonstrate this. For instance . . .

A review of 2009 information for "adverse events" reported to the national control center’s data system shows that, NO major adverse events or deaths were reported for . . .

  • Botanical supplements like St. John’s wort, ginseng, and Echinacea
  • Hormone supplements like DHEA, melatonin, and pregnenolone
  • Phytoestrogen supplements
  • The joint- and cartilage-support supplements glucosamine and chondroitin
  • Vitamins A and E, and only one adverse event each was reported for vitamin B6 and C

In total, 41 major adverse events were reported for the entire spectrum of supplements including botanicals, amino acids, and vitamins, and only one was a death.

In contrast, more than 7,000 major adverse events were reported for pharmaceutical drugs, including a total of 496 deaths. And based on previous studies, we know the overall death rate for physician prescribed drugs to be far higher.

UN: Freeze Funding of Iran Counter-Narcotics Efforts

Surge in Executions for Drug Trafficking

(London) – The United Nations agency charged with combating illicit drug trafficking should withdraw its support for counter-narcotics police operations in Iran until the death penalty for drug offenses is abolished, six rights groups said in a letter published today. The groups made the plea after Iran’s judiciary hanged 18 alleged drug traffickers within 24 hours on December 3, 2014, bringing the number of drug offenders executed in the country during 2014 to at least 318.
Reprieve, Human Rights Watch, Iran Human Rights, the World Coalition Against the Death Penalty, Harm Reduction International and the Abdorrahman Boroumand Foundation said the United Nations Office on Drugs and Crime (UNODC) should follow its own human rights guidance and impose “a temporary freeze or withdrawal of support” if “following requests for guarantees and high-level political intervention, executions for drug related offenses continue.” The six organizations warned the UNODC of “the widening gulf between Iran’s rhetoric and the realities of its justice system,” and described the agency’s decision to continue funding supply-side counter-narcotics efforts in the country as “ineffective if not counterproductive.”
“As Iran executes alleged drug offenders in ever-greater numbers, it beggars belief that the UN sees fit to continue funding Iranian anti-drug operations,” said Reprieve director Maya Foa. “How many more hangings will it take for the UN to open its eyes to the lethal consequences of its current approach, and make its counter-narcotics support conditional on an end to the death penalty for drug offenses?”
The UN agency’s records show it has given more than $15 million to “supply control” operations by Iran’s Anti-Narcotics Police, funding specialist training, intelligence, trucks, body scanners, night vision goggles, drug detection dogs, bases, and border patrol offices, the groups said. UNODC projects in Iran have come with performance indicators including “an increase in drug seizures and an improved capability of intercepting smugglers,” and an “increase of drug-related sentences.”
The United Kingdom, Ireland, and Denmark have all chosen to withdraw their support from Iranian counter-narcotics operations administered by the UNODC because of concerns that this funding was enabling the execution of alleged drug traffickers. When announcing its decision to do so, Denmark publically acknowledgedthat the donations are leading to executions.
The groups had previously written a letter to UN Secretary General Ban Ki-Moon in May 2014 on the issue of UNODC counter-narcotics funding in Iran and Vietnam. In their letter, the groups expressed concern that UNODC continuing support of Iran’s counter-narcotics operations was “lending legitimacy” to executions of drug offenders. In an August 2014 response, UNODC Executive Director Yury Fedotov responded that his agency sought progress through “engagement and dialogue,” and that he was “gratified” by “potentially favourable developments regarding the application of the death penalty in relation to drug offenders in Iran.”

Iran’s anti-narcotics law imposes a mandatory death sentence for manufacturing, trafficking, possession, or trade of five or more kilograms of opium and other specified drugs, and 30 or more grams of heroin, morphine, or specified synthetic and non-medical psychotropic drugs, such as methamphetamines. International law requires countries like Iran that retain the death penalty to impose it for only the “most serious crimes,” which does not include drug crimes.

Although international law says that all death sentences should be subject to appeal, Iran has apparently limited appeals in drug-related cases. Figures suggest Iran is executing those charged with drug offenses in increasing numbers, despite recent calls for reform by the chair of the country’s Human Rights Council, Mohammad Javad Larijani, who said there were legislative efforts under way to end the death penalty for drug-related offenses.
The rights groups are not aware of any pending legislation in parliament that would end, or even reduce, the number of executions related to drug offenses. On December 16, the Iranian Students’ News Agency reportedthat a high ranking official with the country’s counter-narcotics agency opposed the elimination of the death penalty for drug traffickers, noting that any changes in the law would have to be made by the Expediency Council, an advisory body to the supreme leader, and not Iran’s parliament.
Harm Reduction International and Human Rights Watch previously urged UNODC to freeze funding of drug enforcement programs to Iran, and said Iranian authorities should move quickly to end the death penalty for drug-related offenses. The two groups first met UNODC officials in Vienna in 2007 to discuss concerns regarding the execution of drug offenders in Iran.

12 Of The Sketchiest Things The DEA Has Done While Waging The War On Drugs

The Drug Enforcement Administration was established under the Justice Department in 1973 by President Richard Nixon. Its mission was to keep the nation off and away from drugs, which, at least according to the White House, were a moral evil and catalyst of criminal behavior. The agency was formed just two years after Nixon launched what became known as the “war on drugs.” Congress and the rest of the nation remained convinced that the scourge of narcotics and drug abusers — and perhaps particularly those who were young, poor or black — was pounding at the gates. Over the next four decades, with most drug policy now firmly in the grips of law enforcement officials, the DEA’s annual budget saw a fortyfold increase, going from a paltry $75 million to nearly $3 billion in 2014.

With more than 11,000 employees and a host of responsibilities, the agency’s activity has expanded worldwide, all the while attracting scrutiny from critics of the drug war who contend that the DEA is an ineffective agency that uses controversial tools to enforce often misguided or unjust federal drug laws.

The catalog of controversies below helps explain why the public has often questioned the DEA’s priorities, as well as the methods it employs to advance them. While the DEA does its best to keep many of its dealings out of the public eye — it regularly claims secrecy is imperative to the success of its anti-drug operations — here are some of the most sketchy, messed up things that we know it has done:

The DEA claimed Prohibition was a success.

Most historians believe the “noble experiment” of alcohol prohibition in the 1920s backfired, creating a myriad of negative unintended consequences and serving as a lesson about the hazards of governing public morals. The DEA, however, tells a different story. In 2010, the DEA and the International Association of Chiefs of Police released a report providing key arguments against drug legalization. In one passage, first highlighted by the Republic Report, the report set out to combat what it called the “myth” that “prohibition didn’t work in the 20’s and it doesn’t work now.” Its main argument was that the 18th Amendment didn’t go far enough to restrict the manufacturing and consumption of alcohol at the onset of Prohibition.

Citing figures that suggest there was a decline in alcohol use during that 13-year period — statistics that are regularly contested and impossible to verify — the document argues that Prohibition was a successful policy. The report also downplayed the secondary effects of banning alcohol, such as the precipitous rise of organized crime, at one point suggesting that those effects were increasing before the enactment of Prohibition.

Unsurprisingly, the report made no mention of the clear negative parallels between early-20th century Prohibition laws and today’s laws that target drugs. In both cases, strict prohibition has taken away resources from treatment for addiction and abuse, overburdened court systems and jails, fostered corruption in law enforcement, propped up organized crime and even, some argue, created a damaging disrespect for the rule of law. In return, these incredibly costly enforcement experiments have largely failed to actually limit people’s consumptive habits.

The DEA imprisoned an innocent suspect in a holding cell for five days without food or water.

In 2012, 24-year-old Daniel Chong was detained by DEA agents in San Diego after his friend’s house was targeted by a drug raid. Chong was told there were no plans to charge him and that he’d be released the same day. But he wasn’t released, and agents who heard or saw him over the next five days did nothing, each believing he was somebody else’s responsibility. Chong was trapped in a windowless 5-by-10 enclosure without food or water, all for the crime of being in the wrong place at the wrong time. When he was finally discovered, he was incoherent and required medical attention. He said he’d drank his own urine to survive, and at one point attempted suicide. At some point, Chong began to carve “sorry mom” into his arm with broken glass from his eyeglasses, which he ate before being released.
